Apex Storm Tours
A DBA of Sprabary Enterprises LLC
Effective Date: February 11, 2026]
 
1. ACCEPTANCE OF TERMS                                                                                                                                                     

     By booking, paying a deposit, or participating in any tour offered by Apex Storm Tours (“Company”), the participant (“Guest”) agrees to be bound by these Terms & Conditions.
If you do not agree, do not book.

2. NATURE OF ACTIVITY & ASSUMPTION OF RISK
   
 Storm chasing involves inherent and unpredictable risks, including but not limited to:

  • Tornadoes

  • Hail

  • Lightning

  • High winds

  • Flash flooding

  • Flying debris

  • Motor vehicle travel across long distances

  • Rural or remote environments

     Guests acknowledge that tornado sightings are not guaranteed. Weather conditions are unpredictable and vary seasonally and geographically.
Participation is voluntary and at your own risk.

3. BOOKING & PAYMENT TERMS
 

  • A non-refundable deposit is required to secure a tour spot.

  • Remaining balance is due no later than [14] days before tour start date.

  • Failure to pay balance by the due date may result in cancellation without refund of deposit.

Spots are limited and reserved on a first-come, first-served basis.

4. CANCELLATION POLICY

Guest Cancellation

  • Deposits are non-refundable.

  • Cancellations made more than [14] days prior to departure may receive partial refund at Company discretion.

  • No refunds will be issued for cancellations within [13] days of tour start however Guest will have the option to move their purchased tour to another future tour.   

No full Refunds For:

  • Lack of tornado sightings

  • Personal schedule conflicts (case by case basis at tour companies desrection)

  • Travel delays

  • Voluntary early departure

  • Failure to meet at designated starting location


5. COMPANY CANCELLATION

Apex Storm Tours reserves the right to cancel a tour due to:

  • Insufficient bookings

  • Severe or unsafe weather conditions

  • Vehicle failure

  • Guide illness

  • Insurance or regulatory issues

  • Force majeure events (acts of God, government orders, disasters, etc.)

If Company cancels prior to tour start, payments can either be refunded back to custumer or transferred to a future tour at Company discretion.
The Company is not responsible for airfare, lodging, or travel expenses outside the tour package.

6. MINIMUM PARTICIPANT REQUIREMENT

Tours require a minimum number of participants to operate. If the minimum is not met, the Company may cancel or reschedule the tour.

7. ITINERARY & WEATHER DECISIONS

Storm chasing routes are determined in real-time based on weather data.
The Company reserves full discretion to:

  • Change routes

  • Alter destinations

  • Adjust daily plans

  • End chase days early

All decisions are made for safety and weather optimization.

8. MEDICAL FITNESS & ILLNESS POLICY

Fitness to Participate
Guests must be physically and mentally capable of:

  • Extended vehicle travel (5–7+ hours daily)

  • Rapid weather changes

  • Standing outdoors in windy or dusty conditions

  • Entering and exiting vehicles quickly

Guests assume responsibility for their health during participation.
Contagious Illness Policy
Guests who are experiencing symptoms of contagious illness — including but not limited to fever, flu-like symptoms, vomiting, diarrhea, COVID-19, persistent cough, or other communicable disease — must not attend the tour.
Apex Storm Tours reserves the right to deny participation to any Guest who appears visibly ill at departure.
If a Guest is denied participation due to illness, no refund will be issued.
Medical Conditions & Medication
Guests are responsible for:

  • Disclosing serious medical conditions that may affect participation

  • Bringing all required medications

  • Keeping medications accessible

The Company does not administer medication and is not responsible for medical management.
Emergency Medical Authorization
Guest authorizes Apex Storm Tours to seek emergency medical treatment if deemed necessary. All medical expenses are the sole responsibility of the Guest.

9. CONDUCT POLICY

Guests must behave respectfully and responsibly.
The Company reserves the right to remove any participant without refund for:

  • Reckless behavior

  • Illegal activity

  • Harassment

  • Disruptive conduct

  • Failure to follow guide safety instructions

Storm chasing requires strict compliance with guide instructions.

10. TRAVEL RESPONSIBILITY

Guests are responsible for:

  • Transportation to and from the tour’s starting and ending location

  • Personal travel insurance (recommended)

  • Personal Meals during the tour and any other purchases for entertainment made during the tour. 
    -Customer is responsible for lodging outside of the designated tour dates

Apex Storm Tours is not responsible for missed connections or travel delays.

11. MEDIA RELEASE

With the guest permission, Apex Storm Tours would love to add Guest photos to our website and social media pages.  All credit for said videos will go to the Guest.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Apex Storm Tours and Sprabary Enterprises LLC shall not be liable for:

  • Indirect or consequential damages

  • Emotional distress

  • Lost travel expenses

  • Weather-related dissatisfaction

  • Acts of third parties

Participation is voluntary and at Guest’s own risk.

13. INSURANCE

Guests are strongly encouraged to obtain:

  • Travel insurance

  • Medical insurance

  • Trip cancellation coverage

The Company does not provide personal insurance coverage.
 

Apex Storm Tours Severe Weather Execution Guarantee
 

1. Guarantee Overview

Apex Storm Tours is committed to professional forecasting, strategic positioning, and safe storm interception across Tornado Alley. While severe weather is inherently unpredictable, we take our execution responsibility seriously.

This Guarantee applies only in the rare event that Apex Storm Tours’ negligence directly prevents guests from experiencing any severe weather activity during the entirety of the scheduled tour.

2. Definition of Negligence

For purposes of this Guarantee, “Negligence” means a clear and material failure by Apex Storm Tours to:

  • Monitor and interpret available forecast data in a professional manner,

  • Pursue viable severe weather targets within safe operating conditions,

  • Operate the tour in a reasonably competent and prepared manner.

Negligence must be substantial and directly responsible for the complete absence of any severe weather experience during the entire tour.

3. What Does NOT Constitute Negligence

The following situations do not qualify for a refund under this Guarantee:

  • Unfavorable atmospheric conditions

  • Underperforming storms

  • Bust forecasts despite reasonable effort

  • Mechanical issues, vehicle breakdowns, equipment failure or act of God

  • Traffic delays or road closures

  • Guest illness or inability to participate

  • Isolated missed chase opportunities

  • A single missed day of chasing 

Guests acknowledge that storm chasing involves travel risks and operational variables outside the control of Apex Storm Tours.

4. Severe Weather Experience Defined

A “Severe Weather Experience” includes but is not limited to:

  • Tornadoes

  • Supercell thunderstorms or QLCS systems

  • Rotating wall clouds

  • Large hail

  • Structured mesocyclones

  • Significant lightning displays or flash floods

  • National Weather Service warned severe storms

The presence of any of the above at any point during the tour satisfies the performance standard of this Guarantee.

5. Refund Terms

If Apex Storm Tours’ negligence is determined to have directly prevented guests from experiencing any severe weather for the entire tour duration:

Guests will have the choice to receive a 50% refund of the remaining tour price excluding the non refundable deposit, or 50% credit towards a future tour cost.  

No refund applies to:

  • Lodging outside of tour dates

  • Travel expenses

  • Personal costs

  • Third-party service fees

6. Determination Clause

All determinations regarding operational decisions, forecasting efforts, and qualification under this Guarantee shall be made in good faith by Apex Storm Tours management based on professional judgment.
 

No Severe Weather Goodwill Policy
 

7. No Severe Weather Goodwill Refund

While severe weather cannot be guaranteed, Apex Storm Tours is committed to delivering the most active and engaging experience possible.

If guests do not experience any qualifying severe weather activity at any point during the entire scheduled tour, Apex Storm Tours will provide:

Either:

  • A 25% refund of the remaining tour price excluding the non refundable deposit 
    OR

  • A 25% credit toward a future tour (valid for 24 months)

This Goodwill Policy applies regardless of fault and is separate from the 50% Negligence Guarantee outlined above.

8. Definition of “No Severe Weather”

For purposes of this policy, “No Severe Weather” means guests did not witness any of the following during the entire tour:

  • Tornadoes

  • Supercell thunderstorms or QLCS systems

  • Rotating wall clouds

  • Large hail events

  • Structured mesocyclones

  • National Weather Service warned severe thunderstorms or Flash Floods

The presence of any one of the above satisfies the severe weather experience requirement.
 

Definition of “Safe Chase Range”
 

“Safe Chase Range” refers to a geographic area that Apex Storm Tours determines, in its sole professional judgment, can be reasonably and safely reached within a practical driving distance and timeframe while maintaining:

  • Legal driving practices

  • Adequate rest periods for drivers and guides

  • Vehicle safety standards

  • Reasonable fuel and operational logistics

  • Safe positioning relative to storm structure

Safe Chase Range does not require pursuit of severe weather targets that:

  • Require excessive or unsafe travel distances

  • Create unreasonable fatigue risk

  • Require overnight emergency relocation without adequate planning

  • Exceed practical operational limits for the tour schedule

  • Involve extreme terrain, flooding, road closures, or hazardous conditions


\Apex Storm Tours reserves the right to decline pursuing any target that falls outside Safe Chase Range, even if severe weather is occurring elsewhere.
 

9. Limitations

  • Refund applies to base tour price only and does not include the deposit.

  • Lodging, travel expenses, personal costs, and third-party fees are excluded.

  • Policy applies only if no qualifying severe weather occurs during the entire tour.

  • Partial Severe weather days, marginal storms, or limited visibility of Storms do not qualify.


14. GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of Texas.
Any disputes shall be resolved in the courts of Denton County, Texas.

15. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.

16. ENTIRE AGREEMENT

These Terms & Conditions, along with the Liability Waiver and Privacy Policy, constitute the entire agreement between Guest and Apex Storm Tours
